Daps – Privacy Policy

Daps Sports, Inc. (“we”, “us”, or “our”) provides this Privacy Policy (this “Policy”) to inform you about our
collection, use, disclosure, and storage of data about you that we collect via the Daps mobile app(s),
website, platform, and related offerings and services (collectively, the “Platform”). Please review this
Policy carefully. By registering an account for the Platform, or otherwise using the Platform or
volunteering information to us, you agree to the terms and conditions of this Policy. We may update this
Policy from time to time in our discretion, for example to keep up with changing laws regarding data
processing. We will always keep the current version of this Policy posted on our website. By using the
Platform after a new version of this Policy has been posted, you agree to the terms and conditions of
such version of this Policy. All capitalized terms undefined herein shall have the meaning set forth in our
Terms of Service.
The Platform is hosted in the United States and is subject to U.S. state and federal law. If you are
accessing the Platform from another jurisdiction, please be advised that you are transferring your
personal information to us in the United States, and by using the Platform, you are agreeing to that
transfer and use of your personal information in accordance with this Policy. You also agree to abide to
the applicable laws and U.S. federal law concerning your use of the Platform and your agreements with
us.
PUBLIC POSTINGS
Please keep in mind that, notwithstanding the remainder of this Policy, certain information submitted to
the Platform is publicly visible to Platform users. For example, any public posts and comments you make,
and any information and content submitted on your public profile (i.e. User Generated Content), will be
viewable to other users of the Platform. Information you choose to provide in these areas will
immediately be visible to the public, and other users will be able to view and potentially store or share
such information.
DATA WE COLLECT
“Personal Information” means information that can be used to identify you, and may include your name,
email address, phone number, mailing address, photograph, etc. We collect Personal Information that
you voluntarily provide us, for example when you register a user account, sign up for mailing lists or
newsletters, enter into or pay for an Offering , or otherwise reach out to us. Your submission of Personal
Information is voluntary, but we may be unable to provide you requested information or services if you
choose not to provide necessary Personal Information.
“Other Information” means information that does not identify you personally, and may include technical
details regarding the device you use to access the Platform, IP address, operating system, browser,
referral URLs, page views, location data (if location services are enabled), clicks, etc. Our systems
automatically collect this kind of Other Information when you interact with the Platform. Other
Information also includes information that may originally have been Personal Information but has been
aggregated, de-identified, or anonymized such that it cannot be used to identify any individual.
COOKIES AND SIMILAR TECHNOLOGY
We use “cookies” to obtain certain types of data when your web browser accesses our website. Cookies
are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser
to enable our system to recognize you and your personalized settings, to better understand how you
interact with the Platform, to monitor aggregate usage, and to optimize web traffic routing on our
website. Most browsers have settings to disable or limit cookies, but please note that certain areas or
features of the Platform may not be available or fully functional if you choose to disable cookies for our
websites. We may also use pixel tags, web beacons, session logs, and similar technologies to understand
how our users interact with our Platform and emails. Our website does not respond to “do not track”
signals.
We also use third-party analytics services such as Google Analytics, which help us understand how users
are finding and using our Platform. Google Analytics collects information such as how often users visit
the Platform, what pages they visit when they do so, and what other sites they used prior to coming to
the Platform. We use the information we get from Google Analytics to improve the Platform and our

We do not control third parties' collection or use of your information to serve interest-based advertising.
You may be able to opt out of receiving personalized advertisements from companies who are members
of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance's Self-Regulatory

USE OF YOUR DATA
We use your Personal Information:

to collect your location information and verify your identity and eligibility to use the Platform as
a Sports Figure or Fan;
●
to help you match with Sports Figures and/or Fans who may be of interest based on your
location or preferences;
●
to respond to your inquiries and communications to us;
●
to improve, maintain, and operate the Platform;
●
to provide information regarding your account;
●
to process bid(s) for Offerings;
●
to offer you a more personalized experience on the Platform;
●
to inform you about opportunities, events, or services in which you may be interested, including
those offered by our affiliates;
●
to investigate and prevent possible fraud;
●
to enforce our Terms of Service and/or other policies;
●
to contact you for administrative purposes, such as changes to our Terms of Service, this Policy,
and/or other polices;
●
to exercise or defend our rights and comply with statutory and regulatory requirements,
including responding to lawful requests for information by governmental authorities;
●
to conduct market research; and
●
in other ways that we identify when we collect the Personal Information or which you have
otherwise consented to.
The type of information collected and the purposes listed above are necessary for our legitimate
business interests including, without limitation, to develop our products and services, grow our business,
study how you use our services and inform our marketing strategy.
You can opt out of receiving promotional or marketing emails from us at any time by clicking the
unsubscribe, opt-out, or similar link at the bottom of any such emails. Please note we may still contact
you in connection with your account, updates to the Platform, or any Offerings involving you.
We may use Other Information (which does not identify you personally) for any manner we deem
appropriate, including without limitation to improve, maintain, and operate the Platform.
DISCLOSURE OF YOUR DATA
We will not sell your Personal Information for unaffiliated third-party marketing or solicitation. We may
share your Personal Information with our affiliates and as needed to fulfill the purposes described in the
“USE OF YOUR DATA” section above, including:

with Sports Figures or Fans you seek to enter into Offerings with (for purposes of fulfilling your
Offerings, processing payments relating to Offerings, facilitating your request for information
with regards to such Offerings, or for other communication between interested Sports Figures
and Fans);

with our service providers, such as analytics providers, advertisers, customer support providers,
anti-fraud specialists, and payment processors, who are only permitted to use the data on our
behalf;
●
with our affiliates for their internal uses or to facilitate their assisting us in providing services to
you or notifying you of products, services, or offers that may be of interest to you;
●
as necessary to: (i) exercise or defend our rights or comply with applicable law or orders from
law enforcement and other governmental authorities; (ii) investigate, detect, prevent, or take
action regarding illegal activities or other wrongdoing, suspected fraud or security issues; or (iii)
prevent harm to the rights, property or safety of us, our users, yourself or any third party; and
●
to other third parties as disclosed when you provide the Personal Information or which you have
otherwise consented to.
Additionally, in the event of a merger, consolidation, sale, or transfer of all or substantially all of our
assets or business, one of the assets that would generally be transferred is the data we have collected,
which would be transferred subject to the applicable version of this Policy.
We may disclose Other Information (which does not identify you personally) to any parties and for any
purposes we deem appropriate.
DATA RETENTION, ACCESS, AND CORRECTION; SECURITY
We are based in the United States, and the platform on which the Platform operate are hosted in the
United States. By using the Platform, you consent to your Personal Information being transferred to and
stored in the United States. Some countries may require stricter privacy policies than those described
herein. If you are accessing the Platform from a foreign country, you understand and agree that your
information may be transferred to, stored, and processed in our home jurisdiction or the jurisdiction of
the third parties described herein, and that the data protection and other laws of our home jurisdiction
or the jurisdiction of such third parties might not be as comprehensive as those in your home country.
We may retain your data while you are an active user of the Platform and for so long as we can
reasonably foresee the data may be required in connection with our business relationship with you. In
some cases, we will retain the data for a longer period as necessary to comply with our legal obligations,
follow records retention policies, resolve disputes, and enforce our agreements.
You may access and update your Personal Information by visiting your account profile. You may also
request erasure of your Personal Information in certain circumstances. To request access to, correction
of, or erasure of your Personal Information, please contact us as set forth at the end of this Policy.
We understand the importance of securing your Personal Information. Accordingly, we use
industry-standard administrative, physical, and technological measures designed to protect your
Personal Information from unauthorized access or use. However, no internet transmission can be
guaranteed to be 100% secure from interception or other unauthorized access. Please do not provide
any sensitive Personal Information (like credit card number or social security number) through
unprotected methods like email correspondence.
YOUR CALIFORNIA PRIVACY RIGHTS
California law entitles California residents to certain additional protections regarding Personal
Information. For purposes of this section alone,
“Personal Information” means any information that
identifies, relates to, describes, is capable of being associated with, or could reasonably be linked,
directly or indirectly, with a particular California resident or household. California residents have the
right to request:

information regarding your Personal Information we have collected in the past 12 months
(including the categories of Personal Information we have collected, the categories of sources of
such information, and the purposes for which we have collected such information). Details about
our data collection, use and third-party disclosures can be found in this Policy. In addition, you
have the right to request a copy of your Personal Information;

opt out of the sale of your Personal Information, and notice of whether we have sold or
disclosed your Personal Information to third parties in the past 12 months (and if so, what
categories of information we have sold or disclosed, and what categories of third parties we
have disclosed it to). We do not sell Personal Information to third parties for direct marketing
purposes. Should such change, we will notify users and provide an ability to opt out as required;

cease permitting Personal Information to be collected, used, or disclosed by us and/or by any
third parties with whom we have shared Personal Information;
●
a copy of your Personal Information collected by us in the past 12 months;
●
that your Personal Information be deleted, subject to certain exceptions (i.e. information used to
provide features on the Platform, complete Offerings, honor opt-outs, prevent fraud, spam, and
other abuse, comply with our legal obligations, cooperate with law enforcement, or to exercise
and defend our rights); and
●
opt-out or withdraw any consent(s) previously provided. Please note that even if you opt out
from receiving communications, we may still contact you with important information related to
your use of the Platform.
We will not discriminate against you if you choose to exercise any of these rights. To make any of the
above requests, please contact us as set forth at the end of this policy. We may require verification of
your identity before further processing your request. In certain instances, we may be permitted by law to
decline some or all of such request.
CHILDREN
Our Platform is not intended for users under 13 years of age, and we do not knowingly collect Personal
Information from users under 13. If you are under 13, do not use or provide any information on or
through Platform. If we learn we have collected or received Personal Information from a child under 13
without verification of parental consent, we will take commercially reasonable steps to promptly delete
that information. If you believe that we might have any Personal Information from or about a child under
13, please contact us as set forth below.
THIRD PARTY SITES AND SERVICES
The Platform may include hyperlinks or other references to third-party sites and services. If you visit or
use such third-party sites and services (or third-party functionality such as payment processing services),
please be mindful that the relevant third party (not us) controls the cookies and other technologies it
uses on its sites and how it collects, uses, and shares Personal Information from you. This Policy only
governs our own privacy practices; please review the applicable third-party privacy policy when visiting
or using any third-party sites or services. We may receive compensation from such third parties.
Third parties may provide materials to the Platform that use cookies, web beacons, or other tracking
technologies to collect your information, including information about your online activities over time and
across different websites and other online services. Those third parties may use this information to
provide you with interest-based advertising or other targeted content. We do not control third party
tracking technologies or how third parties use them. Your use of third party applications or services are
governed by the terms and privacy policy of the third party that provided that application or service. This
Privacy Policy does not apply to any third party's websites, services or applications, even if they are
accessible, downloadable, or otherwise distributed through the Platform.
If you decide to use, click on, access, or provide any information to a third party website, you
acknowledge that you are doing so at your own risk. Please be aware that we do not operate, control, or
endorse third party websites that may be linked on the Platform, nor are we responsible for the content
or privacy practices of third party websites. We disclaim any responsibility for your personal information
on third party websites, and we do not make any warranties or representations that any third party
website will function without error or interruption, that defects will be corrected, or that any third party
websites or their servers are free of viruses or other problems that may harm your computer.
When you initiate a payment transaction through the Platform, we may process your payments through
a third-party payment processers. The third party payment processer may collect certain financial
information from you in order to process a payment, including your name, email address, address and
other billing information, and the maintenance and/or use of your information by such third-party
payment processer shall be governed solely by such third-party payment processer’s terms.
ADDITIONAL TERMS REGARDING MOBILE DEVICES
If you use a mobile device to access the Platform or download any of our applications, we may collect
device information (such as your mobile device ID, model and manufacturer), operating system, version
personal information and IP address.
Unless we have received your prior consent, we do not access or track any location-based personal
information from your mobile device at any time while using our mobile application or Platform, except
that it may be possible for us to determine from an IP address the geographic location of your point of
connectivity, in which case we may gather and use such general location data.
We send you push notifications if you choose to receive them, letting you know when someone has sent
you a message or for other service-related matters. If you wish to opt-out from receiving these types of
communications, you may turn them off in your device’s settings.
We use mobile analytics software to allow us to better understand the functionality of our mobile
software on your phone. This software may record Personal Information, such as how often you use the
application, the events that occur within the application, aggregated usage, performance data and where
the application was downloaded from. We do not link the Personal Information we store within the
analytics software to any Personal Information you submit within the mobile application.
DISPUTES
Any dispute over privacy is subject to the provisions of this Policy and our Terms.
